Prime Contractor

For Prime Contractors, a copy of the contract should be filed with the appropriate county clerks office, and a list of subcontractors and suppliers should be provided to the owner of the property.

Subs/ Laborers

For Subcontractors and Laborers, a notice must be provided to the owner of the property and the Prime Contractor by the 15th day of the 2nd month after the month that labor or materials were provided for the project but haven’t yet been paid for. When dealing with non-residential properties, the time to file a notice is the 15th day of the 3rd month after each month that labor or materials were provided but not yet paid for. Subs of Subcontractors, notices should be filed the 15th day of the 2nd month that services were unpaid for.

Suppliers/ Others

For Suppliers and Others, when dealing with residential properties, a notice must be provided to the owner of the property and the Prime Contractor by the 15th day of the 2nd month following the month that labor or materials were provided but not yet paid for. When dealing with non-residential projects, the time to file a notice is the 15th day of the 2nd month, and also the 15th day of the 3rd month, after each month that labor or supplies were provided for the project but not yet paid for.
